1. Accepting this agreement
This End User License Agreement ("Agreement") is a binding contract between you and DriveDr, Inc. ("DriveDr," "we," "our," or "us"). By downloading, installing, or using the DriveDr mobile app, website, or any related services (collectively, the "Services"), you acknowledge that you have read, understood, and agree to the terms below. If you do not agree, do not use the Services.
2. Eligibility & access
You must be at least 9 years old to use the Services. If you are between 9 and the age of legal majority in your jurisdiction, you confirm that a parent or guardian has reviewed and accepted this Agreement.
DriveDr does not issue separate user accounts; access is tied to the app store profile used to download or purchase the Services. You are responsible for keeping your device and store credentials secure, and for all activity conducted through them.
DriveDr may suspend or terminate access if you violate this Agreement, applicable law, or store policies, or if continued access poses risk to the Services or other users.
3. License & permitted use
Subject to this Agreement, DriveDr grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Services on devices that you own or control. This license is solely for personal, non-commercial use related to assessing, maintaining, or customizing vehicles you own or are authorized to work on.
You may not copy, reverse engineer, distribute, modify, lease, or transfer the Services or any part of them except to the extent laws prohibit these restrictions. DriveDr retains all rights not expressly granted.
If you obtained DriveDr through the Apple App Store, this license is further limited to use on Apple-branded products that run iOS and subject to the App Store Terms of Service. If obtained via Google Play, the Google Play Terms of Service also apply.
4. Content generation & informational use
DriveDr includes conversational tools, image recognition, and rendering powered by third-party content generation services. These features generate BuildScore assessments, mechanical suggestions, or visual concepts in response to your prompts.
- Generated output is produced automatically and may be inaccurate, incomplete, or unsuitable for your situation.
- DriveDr is not a certified mechanic, insurer, or financial advisor. All generated responses are for informational and entertainment purposes. Always verify results with qualified professionals before making maintenance or safety decisions.
- You are responsible for reviewing results before acting on them.
- Vendors that power content generation may apply their own retention or model-improvement policies to your prompts or imagery. Review their terms if you need details about how they handle data.
- We may change content generation vendors at any time to keep the Services reliable. The obligations in this Agreement continue to apply regardless of vendor selection.
We may review generated interactions to debug issues, improve quality, or investigate safety and abuse concerns, following the Privacy Policy. We limit each request to the smallest amount of information needed to produce your result, but we cannot control how third-party providers store or use data once it reaches them.
5. Your responsibilities
You agree that you will not and will not permit others to:
- Use the Services in a way that violates any applicable law, regulation, or third-party right.
- Upload content that is unlawful, harmful, harassing, defamatory, infringing, or otherwise objectionable.
- Send malware, automated scripts, or excessive requests that degrade performance.
- Attempt to bypass security measures, probe vulnerabilities, or access accounts that are not yours.
- Use DriveDr output to build a competing product or to train generalized machine-learning models without our written permission.
We may monitor activity to protect the platform and community.
6. Vehicle media & user submissions
You retain ownership of photos, videos, prompts, reviews, or other content you submit to DriveDr (collectively, "User Content"). By providing User Content, you grant DriveDr a worldwide, royalty-free license to receive, transmit, process, and display that content solely to operate and maintain the Services, enforce this Agreement, and comply with law.
DriveDr does not permanently store User Content; it flows through our systems to content generation vendors and back to your device. Residual metadata (such as error logs or usage counters) expires within seven days as described in the Privacy Policy. Vendors may apply their own retention or training policies, so review their documentation if you need more detail. DriveDr cannot access or delete copies that remain on your personal device.
You confirm that you have all permissions needed to upload the vehicles and materials you submit, including consent from any identifiable individuals. Do not upload images or data you are not authorized to share. We may remove or disable access to User Content that violates this Agreement or the law.
7. Subscriptions, renewals & refunds
Access to certain DriveDr features may require a paid plan. Subscription pricing, terms, and included allowances (such as content generation limits) are described in-app or on our website and may change over time.
- Purchases through Apple or Google are billed by those stores. Billing, refunds, and cancellations are managed by the platform where you purchased the plan.
- Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period.
- We may change plan features or pricing for future renewal cycles. We will provide notice in the app or through store notifications before changes take effect.
DriveDr receives only anonymized transaction identifiers and usage counters from the stores to validate eligibility, and these records expire automatically within seven days unless a longer period is legally required. We do not collect names, emails, or payment card numbers.
We reserve the right to suspend or terminate subscriptions for non-payment, suspected fraud, or violation of this Agreement.
8. Updates, changes & service availability
We may release updates, patches, or new versions of the Services that are required to continue using DriveDr. Some updates may install automatically. We may discontinue or modify features, content, or support at any time.
DriveDr strives for 24/7 availability but does not guarantee uninterrupted access. Planned maintenance, outages, or factors outside our control may cause the Services to be unavailable.
9. Third-party services & links
The Services may integrate or link to third-party tools (for example, parts catalogs, checkout providers, or content generation infrastructure). Those services are governed by their own terms and privacy policies, which may include retention or training on data you provide. DriveDr is not responsible for the behavior, content, or data handling of third parties. Use them at your own risk and review their policies if you need more information.
10. Warranty disclaimer
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR SECURE.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, DRIVEDR, ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, VEHICLE DAMAGE, DATA LOSS, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES.
OUR TOTAL LIABILITY FOR DIRECT DAMAGES WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID TO DRIVEDR FOR THE SERVICES DURING THE SIX MONTHS BEFORE THE CLAIM AROSE, OR (B) USD $50. These limitations apply even if we knew of the possibility of damages.
12. Indemnity
You agree to defend, indemnify, and hold harmless DriveDr and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services, your User Content, or your violation of this Agreement or applicable law.
13. Governing law & dispute resolution
This Agreement is governed by the laws of the United Kingdom, without regard to conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
You agree that any dispute with DriveDr will be resolved exclusively in the country or federal courts located in the United Kingdom, and you consent to their personal jurisdiction and venue.
You agree that disputes will be resolved individually and waive the right to participate in class actions or representative proceedings.
14. Changes to this agreement
We may update this Agreement periodically. When we make material changes, we will update the “Last updated” date, post the revised version in the app or on our website, and, where required, provide additional notice. Continuing to use the Services after the updated terms take effect constitutes acceptance.
